1. Agreement Overview
This End-User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Offcourse Golf Inc. (“Company”, “We”, or “Us”) regarding your use of Club Unity, a cloud-based software service.
By accessing or using Club Unity, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the Software.
2. License Grant
Offcourse Golf Inc. grants you a limited, non-exclusive, non-transferable, and revocable license to access and use Club Unity via the web, subject to the terms of this Agreement and your active subscription.
3. Restrictions
You may not:
- Share your login credentials or permit any third party to access Club Unity using your account.
- Copy, modify, translate, reverse engineer, decompile, disassemble, or create derivative works of Club Unity.
- Use the Software for any unlawful purpose or in any way that may damage the Company’s reputation.
4. Subscription & Payment
Access to Club Unity is provided via a subscription model. You agree to pay all fees associated with your subscription according to the terms presented at the time of purchase or renewal.
5. Termination
We reserve the right to suspend or terminate your access to Club Unity, with or without notice, if you violate any terms of this Agreement. Upon termination, your license to use the Software is immediately revoked.
6. Intellectual Property
Club Unity and all associated content, features, and functionality are the property of Offcourse Golf Inc. and are protected by intellectual property laws. You do not acquire any ownership rights by using the Software.
7. Limitation of Liability
To the fullest extent permitted by law, Offcourse Golf Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, Club Unity.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Alberta.
9. Amendments
We reserve the right to modify this Agreement at any time. Changes will be posted within the Software or notified via email. Continued use of Club Unity constitutes acceptance of the updated Agreement.
